One Jet Passenger Agreement

  1. GENERAL: When you purchase a seat on a One Jet flight, a contract is made and each party has certain rights and obligations as set forth below. One Jet, Inc, 1100 Larkspur Landing Circle, Larkspur, CA 94939, is the authorized Public Charter operator (OPERATOR). The price of your trip, dates of the outbound and return flights, origin and destination cities, and other conditions, are as specified in the applicable OPERATOR itinerary and/or your accepted reservation, and are incorporated herein by reference. Unless otherwise specified, the price includes only air transportation.
  2. RESERVATIONS AND PAYMENT: Reservations may be made only through your travel agent. Unless and until full payment has been made, you do not have a confirmed reservation. The only forms of payment accepted for transportation on OPERATOR's flights are checks, money orders, and credit cards. In accordance with federal regulations, all payments will be deposited in Operator's depository (escrow) account at FIRST NIAGARA BANK, 100 E. LANCASTER AVENUE, DOWNINGTOWN, PA 19335. Your payment is additionally protected in part by a security agreement between OPERATOR and UNION BANK, N.A., 1980 Saturn Street, Monterey Park, CA 91755. Unless you file a claim with OPERATOR, or if OPERATOR is unavailable, with Union Bank, within sixty (60) days of arrival (or in the case of a cancelled flight, the scheduled date of arrival) of the last flight of your itinerary, Union Bank shall be released from all liability to you under the security agreement.
  3. AIR TRANSPORTATION: One Jet flights are operated by Corporate Flight Management (DAC), using a 7-passenger Hawker 400XP aircraft. DAC flights are subject to all applicable laws and regulations governing air transportation. OPERATOR and DAC reserve the right to substitute another duly-licensed carrier and/or to change the aircraft type or capacity. No refund will be given for such substitutions or changes.
  4. CHECK-IN INFORMATION: Please refer to your itinerary for check-in information. One Jet passengers must check-in at least 30 minutes prior to scheduled departure time unless notified otherwise. If you are not present at the departure area at least 10 minutes prior to scheduled departure, you will be considered a “no-show;” and your seat may be sold to a standby passenger. In such event, neither OPERATOR nor DAC shall be responsible or liable for your transportation. Please refer to Paragraph 6 below for additional information on no-shows.
  5. CANCELLATIONS BY OPERATOR AND FLIGHT CHANGES:  OPERATOR WILL NOT CANCEL ANY FLIGHT WITH A CONFIRMED PASSENGER BOOKING, EXCEPT FOR CIRCUMSTANCES THAT MAKE IT PHYSICALLY IMPOSSIBLE TO PERFORM THE FLIGHT.  If such a circumstance occurs, OPERATOR will notify you as soon as possible; and if the flight is cancelled, OPERATOR will refund all monies paid for that flight within 14 days.  Further, in the event a flight delay lasts (or is expected to last) longer than four hours from the originally scheduled time of departure, OPERATOR will notify you as soon as possible and will refund, within 14 days of the scheduled flight date, that portion of your payment which applies to any such flight you decide not to participate in.  EXCEPT AS STATED ABOVE, OPERATOR WILL NOT MAKE ANY CHANGE TO A FLIGHT, nor will OPERATOR increase the price of a confirmed ticket once purchased.
  6. PASSENGER CANCELLATIONS, CHANGES OF DATES, AND REFUNDS: Cancellations and change requests should be made by calling your travel agent. Please refer to you itinerary and/or reservation confirmation and this agreement for the refund rules applicable to your reservation. Non-refundable tickets may be changed for a fee of $215 plus any difference in the portion of the un-flown portion of the fare. If the new fare is less than the originally ticketed fare, no value will be credited. Refundable tickets may be refunded to the original form of payment less a fee of $215. In all cases, if a passenger’s original ticket required same day travel and the new itinerary doesn’t meet this requirement, all portions of the ticket, flown and un-flown, will be re-priced to determine the new fare for the reissue or refund. When permissible, refunds will be made within 14 days after the date of cancellation.
  7. BAGGAGE ALLOWANCE AND LIABILITY: Passengers are permitted one carry-on size bag and one personal item. The carry-on size bag must not exceed 50 lbs in weight or 14” (height) by 9” (width) by 22” (length) in dimension. Any overweight or oversized luggage (larger than suitcase size) will be carried, if at all, subject to load restrictions and additional charges by the carrier. OPERATOR and DAC neither assume nor accept liability for lost, delayed, or damaged bags.
  8. RESPONSIBILITY: OPERATOR is the principal and is responsible for making arrangements to provide the services included in the trip. In all cases, transportation is subject to all of the terms and conditions of the direct air carrier’s applicable tariff and/or contract of carriage, if any; Accordingly, you hereby agree that, except as otherwise provided herein, OPERATOR is not responsible or liable for any loss, injury, expense, damage to property, or personal sickness, injury, or death which results directly or indirectly from (a) an act or omission of DAC any other air carrier or other travel supplier, or (b) any other cause or act, of whatsoever nature, beyond the direct control of OPERATOR. Except as otherwise specified herein, in the event of non-operation of any flight due to reasons beyond the control of OPERATOR, OPERATOR’S sole liability shall be to refund to you that portion of the price allocable to the services not provided. Any deviation from the trip that you initiate is solely your responsibility.
  9. IDENTIFICATION: YOU MUST PRESENT GOVERNMENT-ISSUED PHOTO IDENTIFICATION TO CLEAR THE SECURITY CHECKPOINT AND BEFORE BOARDING; SUCH IDENTITY DOCUMENT SHOULD MATCH YOUR NAME AS IT APPEARS ON THE PASSENGER RESERVATION LIST. FAILURE TO PROVIDE THIS TYPE OF IDENTIFICATION COULD LEAD TO DELAY IN BOARDING OR TO DENIAL OF BOARDING, SO PLEASE BE SURE TO HAVE SUCH IDENTIFICATION (SUCH AS A DRIVER’S LICENSE) READY WHEN YOU CHECK-IN.
  10. NOTICES: All communication should be sent to OPERATOR, ATTN: CUSTOMER CARE, at the address shown in Paragraph 1 above, or by email to customercare@onejet.com. Notices to OPERATOR are effective upon actual receipt by OPERATOR.
  11. APPLICABLE LAW: This contract is governed by and shall be construed in accordance with the laws of the State of California, without reference to the conflicts-of-law principles of California or any other jurisdiction.
  12. MISCELLANEOUS: OPERATOR reserves the right to amend this contract without notice to the passenger so long as such amendment is in compliance with applicable governmental regulations or waivers thereof. THE RIGHTS AND REMEDIES MADE AVAILABLE UNDER THIS CONTRACT ARE IN ADDITION TO ANY OTHER RIGHTS OR REMEDIES AVAILABLE UNDER APPLICABLE LAW; HOWEVER, ACCEPTANCE OF A REFUND FURNISHED UNDER THIS CONTRACT SHALL CONSTITUTE A WAIVER OF SUCH OTHER RIGHTS AND REMEDIES.
  13. INSURANCE: Trip cancellation, health, and accident insurance is available for purchase by all passengers. Details of this insurance will be sent to you upon request.
  14. PASSENGER AGREES TO ALL TERMS AND CONDITIONS STATED ABOVE. IF PAYING BY CREDIT CARD, PASSENGER ADDITIONALLY ACCEPTS ALL TERMS AND CONDITIONS OF THE CARD ISSUER AGREEMENT.
